The Role of Courts in the Creation of a European Identity

Vitenskapelig sammendrag

The primary objective is a legal analysis of the European regional courts' role in the construction of a European identity, based on
ostensible European values. In taking a human rights-based approach, the project examines the case law of the courts on migrants. It
analyses jurisprudential deliberations of inherent European values and identities, and whether the migrant crisis has influenced such
ideas. Has the dynamic interpretation of human rights led to an exclusionary turn in the jurisprudence, favouring ‘us’ over ‘them’, the
migrants, who do not share 'our' common values and thus identity? Do understandings of belonging and perceptions of threat permeate
the judgements? Courts play an important role in the European response to migration. The secondary objective is thus an examination
of the political pressure exerted on the courts and whether it negatively affects the jurisprudence on migration. Recent judgements
indicate the consolidation of a tougher course towards migrants.
