Sammendrag
The main purpose of this chapter is to present the legislation and
the legal framework that apply to decisions on the right to necessary
health care from the specialist health service in Norway. These decisions
shall be based on the patient- and user rights act and the priority
regulation. In this context, the term «prioritization» refers to
saying yes to some patients entitled to health care, and no to others
who do not fulfill the legal criteria. Our aim is to show how the legal
regulation both allows and restricts individual access to specialist
health services. Knowledge and understanding of the legal regulation
is necessary in order to make lawful decisions about access to
health care, and thereby contribute to rule of law, equity and fair
distribution of health care.
