Sammendrag

Russian legislation includes a requirement to obtain a permit to navigate through the Northern Sea Route (NSR). Such a veiled requirement to obtain prior authorization presupposes that a coastal State may give or withhold its consent to a vessel's passage. Russia views Article 234 of the United Nations Convention on the Law of the Sea (UNCLOS) as providing the international legal basis for this measure. Although this practice is controversial, many ships have sought permits from the coastal administration. This article investigates whether prior authorization, as practiced by Russia within the NSR, is consistent with Article 234 of UNCLOS
