Preventive detention in Norway.

Vitenskapelig sammendrag

Preventive detention is the ultimate penalty in Norway. While formal sentenced of life imprisonment were abolished in 1981, a Court may order "forvaring", allowing for the lifelong preventive detention of someone beyond the maximum fixed-term of 21 years if they continue to pose a danger to society. This is the deepest end of custody in Norway. The number of prisoners subject to this form of punishment has increased in recent years, from 50-60 in 2002 t0 90+ in 2016, yeat current knowledge about the development og "forvaring" as the ultimate sanction in Norway, and what it means in practice remains limited. The aim of this research project is to rectify this, and to critically assess for the first time the development and implementation of the use of preventive detention in Norway in the light of internationsl standards on ultimate penalties.

Metode

Main objectives:
*describe the historic development of the use of preventive detention in Norway - from sikring/etterforvaring, via sikring, to forvaring and tph/to (historic method)

*to critically assess its implementation in the context of international trends and standards (qualitative method)

*to develop the first national database to capture key characterisics of prisoners serving preventive detention (quantitative method)

*to interview prisoners about their personal experiences on "forvaring" (qualitative method)
